I used to believe Beth Karas was the most accurate of the reporters. But she wasn't accurate in an interview with Jane Velez Mitchell on Mitchell's new internet page. Karas said that Martinez had the opportunity on the rebuttal case to bring in witnesses about the premeditation because in mitigation he can talk about anything. That is incorrect because the judge and Nurmi both stopped Martinez if he didn't directly rebut what the defense witnesses said in his rebuttal case.
Karas also said that Martinez didn't present any witnesses or evidence on premeditation except he may have brought in a witness from the store where Arias bought the gas can. In his case in chief, Martinez presented the same witnesses in this retrial as he did in the murder trial except for Ryan Byrnes and Mimi Hall. This jury heard from Dr. Horne, Flores, the Yreka detective who investigated the burglary at Arias grandparents home where the .25 caliber gun she used to shoot Alexander was stolen, the rental car agent who rented her the car as a blonde and the Wal-Mart employee who testified she didn't return the gas can. All of this spells premeditation.
When Flores was on the stand, Martinez also read the transcript of the first trial where Daryl Brewer testified that she called him a week before the murder and asked to borrow two gas cans, and the transcript of Ryan Byrnes testifying she called him a week before the murder and asked him she could come visit him in Salt Lake City, Utah, and that when she showed up 20 hours after she was expected they grinded and kissed. Martinez also showed a video of Flores interrogation of Arias on videos and in a phone call.
