The burden is on the defense to prove mitigating factors and they didn't do that because they spent all their time trying to prove Travis Alexander was a sex maniac, pedophile and abuser.
In his closing statement, Juan Martinez brought out that Alexander's character was not an issue, Arias' character was.
Juan Martinez said there were no mitigating factors and reminded the jury that another jury had found Arias guilty of premeditated murder and extreme cruelty and they had to accept that. He said Alexander was conscious during the attack and felt a great amount of pain.
He said Arias showed no remorse. "Jodi Arias talks out of both sides of her mouth."
Martinez said Borderline Personality Disorder is NOT a mitigating factor because it doesn't have anything to do with his murder. BPD doesn't give her the right to murder him. She has a fear of abandonment but knows right from wrong.
"You don't have to be a certain age to commit a crime so age is not a mitigating factor."
He said Jodi Arias was a spoiled child and she left home because she was grounded, not abused.
He said there was no physical or emotional abuse in the relationship between Arias and Alexander, that she gave as much as she got.
He ends with: "We forgot why we are here" as he holds up more autopsy pictures. Then he asks the jury to "remember the victim" and come back with a verdict of "death."
I thought his closing argument accomplished what he needed it to accomplish. He didn't need to prove guilt, premeditation or extreme cruelty. He just had to prove that Arias and Geffner were lying and accusing Alexander of being a bad person to cover up what she did.
He brought what she did to the forefront by showing the graphic autopsy pictures. What was heartbreaking was to hear that the Alexander family sobbed and sobbed in the courtroom and afterwards as they again saw the autopsy pictures and heard about all his suffering.
I don't blame the Alexanders for walking out when Nurmi read Arias's fake attempt at remorse. They are disgusted at Jodi Arias' trying to manipulate the jury when it is clear she feels no remorse or she would have taken responsibility and wouldn't blamed his murder on him and wouldn't have lied about their loving caring brother being a pedophile and abuser and murdered him all over again in the courtroom.
