I found the tapes of Martinez closing argument where he describes how Jodi Arias stabs Alexander in the heart in the shower and gets defensive wounds on both hands as he tries to grab the knife, then he makes his way to the sink where he stands and she stabs him in the back and then he tries to get away from her and she chases him down as he moves down the hallway and she slits his throat from ear to ear and then she drags him to the sink and shoots him in the head before dragging him back to the shower. He points out it is a strike to kill, not in the heat of passion. He says Alexander was dead by the time he was shot because there is no blood in the tract which means the heart isn't pumping when he is shot. And the casing is found on top of the blood. This stabbing is a directed attack. She is cognizant of what is going on. Dragging him back to the shower is an attempt to cleanup. He also talks about her directed behavior of deleting pictures off the camera after he is dead.

Justice the first list of mitigating factors was for the first sentencing trial and the second list is for the retrial.

Observer the list is incomplete' I also believe the order is incorrect' utube upload date, their are five times Martinez discussed the slaughter to the first jury!
I rely most of Martinez's Final slaughter description to the jury' it was just prior to their deliberations that resulted in' guilty for aggravation phase, Martinez in that description' exacts that only Jodi knows and that his assumptions are assumed, then Martinez rested!
Including all the above theirs conflicting possibilities explained by Martinez. Frankly a heart stab results in a heart attack that eliminates the possibility of Travis's forensic defensive wounds!
Their was only 2 minutes' and if attack started with Travis sitting in shower theirs no possibility of the hearts 'Vena Cava' puncture being the first wound, due to him fighting back and escaping, and Dr. Horn said the neck wound was multiple slicing, sawing, I just relate that Jodi started by slicing his neck in the shower and after dragging him back to the shower she again went after his neck. I've not been convinced otherwise since Martinez first explained.
Vena Cava = Large Vein that supply's the heart muscle blood to pump and a unrelated Vena Cava minor (blood return from lower extremities) helps understanding, both Veins are considered the heart due to heart sack incapsulation, although their not muscle!
Dr Horn stated after a Vena Cava puncture' theirs a slim possibility of Travis standing and even up to 10 feet of travel before collapse, but (I'm saying = medical experts synopsis) its far fetched to assume conscious defensive fighting back hand wounds and the to sink, and then to hallway movement.
I also disagree with Martinez swoop smear explanation, that Travis was on that side of hallway, I believe Travis neared the carpet threshold but that carpet stain was from Jodi heaping bloody clothing there. (bloody trail was down hallway) The grout for floor tiles is remarkablely pristine where Martinez claims Travis's upper body rested, grout doesn't clean without special circumstances.

From Flores initial investigation report!
The initial report from Dr. Horn was that the gunshot wound to Travis’ head would not have been fatal. The gunshot would have possibly disabled him temporarily. The knife wounds to his back did not enter the chest cavity; therefore they were not fatal either. He also had obvious defensive wounds to his hands tending to show he did attempt to protect himself during the attack. The fatal wounds consisted of a single stab wound to the center of his chest, which punctured his superior vena cava. This wound along with the final throat slicing were the cause of death. Manner of death would be listed as homicide.
Reading this report (self-defending) Jodi drops the 2 Ninja BS creating the linebacker poise defense, and the bullet thru brain matter causes shock waves that eliminate defensive wounds, plus bullet trail didn't bleed!
Throat slicing is not called a single slice, the damage was later documented as sawing or 4 slices!

It breaks down the issues stated in the transcripts, specifically what Arias said and what she meant and the position the judge was put in.
I am pleased to see that it is on the record that the judge fully recognizes the manipulation by Arias on this issue.

Many posts ago, I found it quite easy to refute each and every one of them and I am a just a layman, a member of the general public.

During the first trial (mis-trial) the Jury deliberated 3 days' how that played-out must-be exacted for understanding, News reported 17 hours of jury time from start to finish' and reported 14 hours were available for deliberations and breaks, meaning 3 hours of the 17 was spent waiting for the mini-trial, answer to Jury question!
I call it a mini-trial because judge explained then defense explained what helped their perspective and then Martinez explained what helped the states perspective, funny how the actual answer was omitted!
By my recall estimation!
Day1! Less than 2 hours in Deliberation room' Jury foreman picked.
Day 2! Mini-trial interrupted Deliberations for over half of the day (remember Judge received notice' and Deliberations halted awaiting courtroom assembly = the 3 hours unaccounted) and the Allen Charge wasn't formally read or told = consequences explained!

Day 3! Jury asked another question stating we are undecided' Judge used Allen Charge to call mis-trial' the long Memorial Day weekend and out-of-state families travel was a minor consideration' hopefully minor' we can only guess!
To say undecided is a explanation of progress accomplished' whereas Deadlocked or Stalemated explains no further attempt to deliberate can be considered useful!
As I said' every jury person related shock and disappointment that the deliberations ceased, no matter how they sided, even tears and saying sorry to the Alexander family was exposed. In time we will hear the silent jurors mis-trial decision perspective!

Last week Judge Stephens had told the jury the trial could be over by the end of this week.
I think it is unlikely that will happen since Nurmi said he was recalling Miccio-Fonseca, Pseudonym computer guy John Smith and the defense's former computer guy Lonnie Dvorkin to the stand this week.
Nurmi spent two days with Geffner so Fonseca will be probably be on the stand another two days and then Smith and Dvorkin at least a day each. Arias allocution will take probably a half a day or a day and the closing statements will take a day or two. Most likely it will be the end of next week before the jury starts deliberating.
Nurmi will take his time and have his witnesses repeat that Alexander is a porn watching sex maniac and violent abuser and Arias is a naïve little girl who just wanted love, marriage and children so it is fresh in the jury's minds when they go to deliberate.
If they haven't already got their mind made up, I think it is the closing statements that will convince the jurors to vote for death over life.
I watched the closing statements again from the first trial to see how Martinez brought it home to the jury so that they found her guilty of first degree murder. I am sure in this last closing statement, he will repeat the same performance to show how Alexander suffered to get a death sentence. It was masterful how he showed the knife attack with dialogue and photographs by explaining that the attack was planned and premeditated and directed. It wasn't a frenzy attack in the heat of the moment. Each stab wound was direct and calculated. She had one purpose in mind: make sure Alexander was dead.
Martinez showed the last picture of Travis Alexander alive. The photo showed him from the waist down sitting on the floor of his shower to show that she ambush him where he was his most vulnerable, helpless, unarmed, naked and sitting on the floor of his shower. The picture showed a vulnerable victim, not an angry predator who would explode, body slam her, chase her and tackle her like a linebacker and threaten to kill her. He detailed each stab wound to show that she was not in a fog, not in a rage, but that she was determined to make him suffer and kill him. Then he showed how she dragged the body back to the sink to finish him off with a gunshot to the head and then dragged the body back to the shower to wash off all the evidence and then deleted the pictures on the camera which shows someone who is clearly thinking and planning how to get away with murder.
I am interested to see what kind of performance Arias gives in her allocution and how Nurmi tries to minimize the suffering and make Arias the victim and Alexander the villain. This time they have left out the self defense and are focusing on assassinating Alexander's character and turning Arias into a mentally ill little girl who just wanted to love him.
While Martinez will use facts and evidence, Nurmi most likely will just blither and blather and hope the jurors feel sorry for Arias and give her life.

In watching this again, I was stricken by the look on Willmott's face when Juan was explaining how much Travis suffered. Its as if it had not dawned on her till then, that the man DID suffer greatly. She looks mesmerized. Check it out, start at point 37:05 and to to point 38:27 Willmott stops writing her notes. She stops looking around. She stops everything! Its almost as if she was hypnotized.
I also took notice that Arias was 'crying' and taking deep breaths now and then, until the jurors went out. Then, the crying suddenly stops. Like turning off a water spigot or a light switch!

In this video, we hear Ryan Burns and then immediately we hear Darryl Brewer. (Points 3:07 to 4:12)
I still think the ‘sex tape’ sounds much more like Darryl than Travis! It is his ‘penis and hand’ photo that was shown and I still say the voice on that sex tape sounds more like Darryl’s. I would only be convinced that it was Travis’ voice IF an FBI specially trained voice recognition expert could somehow prove it to me.
I know others have said the family said it was Travis, and perhaps part of that tape was Travis, but for the most part…I hear Darryl. Is it just my hearing?

I wish I had Martinez's final statement/paragraph transcribed, it is 2 hours of mostly Martinez at his best! It resolves some attack testimony confusion, the Jodi fog in not mentioned but Jodi madness is discussed by Nurmi, a lot of what this trial strategies began back then!
Willmott is learning from Martinez' she would develop into a valued attorney hadn't she ruined her moralities, a future 'court appointed attorney' defending criminally insane future at best, for her and Nurmi!
This 2 hour trial phase is the case in a nutshell, most everything else was waste.

I loved that video because it exactly sums up the premeditation, the murder, the extreme cruelty and why she deserves the death penalty.
