The Jodi Arias mitigation retrial is different than most mitigation trials because the defense is putting the victim on trial rather than begging for Arias life.
In most mitigation trials, the defense calls relatives, friends and teachers of the convicted murderer to show he or she was a good daughter, friend and student.
Arias and her family won’t do this because they believe Arias was wrongfully convicted and what the state is doing is trying to kill an innocent person.
On Jan. 25, Sandra Arias signed a petition: Government of Arizona. Don’t kill a battered woman for defending herself. Save Jodi.
Arias and her family think signing petitions, selling propaganda and drawings and soliciting donations to pay a high powered appellate attorney on Internet sites Jodi Arias is Innocent and Justice4Jodi is going to win Arias her freedom.
They are as misguided as these murderers who don’t defend themselves because they don’t recognize the government so believe the government has NO right to try them or kill them. They end up being executed because the government does have that right.
Jodi’s mother could take the stand and say what she said to Detective Flores: “Jodi has mental problems. Her friends say she is Bi Polar. She needs help. She didn’t have a bad childhood. She is making this all up. Please don’t kill my daughter.”
But she won’t because that would make Arias furious. She would be happy if her mother stood up and said: “I was a bad mother. I smoked pot the day I delivered Jodi. I beat Jodi with a wooden spoon and I didn’t protect her from her abusive father. Jodi was the perfect child. She didn’t do anything wrong. She is a battered woman defending herself from a monster just like her father.”
But she won’t say that because it is not true and because Martinez would show the interrogation tape where Sandra Arias tells Flores that Arias didn’t have a bad childhood and just made that up and that Arias would call her one minute happy and the next angry or sad, that she grew pot on the roof and she and Jodi’s father called the sheriff. That shows Bill and Sandra Arias were NOT drug users as Arias made them out to be.
Because this is a new jury and essentially a retrial, the defense has left out any mention of self defense, the lurid details of Arias’ sex life from the time she was a teenager and that she was Alexander’s dirty little secret.
Instead, the defense is painting the picture that Arias killed Travis Alexander because he was a sex maniac who lured her to Mesa to use her for sex and Arias thought he was going to propose to her and when he didn’t she just lost it and stabbed him 29 times and slit his throat and shot him in the head.
Arias thinks she manipulated the jury in her “secret” testimony into believing she was remorseful and a victim of child abuse and domestic violence and that when she tells them she has been donating her hair and proceeds from her drawings and personal belongings to food banks, children and women dying of cancer and survivors of domestic violence, none of those gullible saps on the jury will want to put a victim and philanthropist to death.
It’s not going to fly because from the jury questions this jury doesn’t believe her lies anymore than the jury that convicted her of first degree murder and eight jurors voted for death.
This time I think Martinez has a better chance at the death penalty because I think Arias’ 18 days on the stand made four of the jurors in the last trial form a sympathy bond with her and the more they saw her the more they thought maybe she was abused and it was only one murder and what if that was heir daughter or granddaughter on the stand could they vote to kill her.
Plus Martinez will drive home the cruelty of the crime with the autopsy pictures and the evidence that Arias is making up the pedophile and abuse claims to smear the victim and she continues to lie to this jury and point out the inconsistencies in her testimony at the retrial versus the murder trial.

Since Arias slaughtered Travis, she.....
- has carried on her plan to cover up her tracks
- disposed of evidence,
- finally turning on her phone once out of Arizona after leaving Mesa
- calling Travis knowing full well that he was lying butchered in his bathroom,
- involving Ryan,
- sending flowers to Travis' grandmother,
- writing a despicable letter to the Alexander family,
- attends Travis' memorial service knowing she murdered him,
- calling the police to be "helpful" when in fact she wanted information on what they knew,
- getting another gun, just "in case" she needed it,
- stating to police that she wasn't even in Mesa at the time of the murder,
- coming up with the ninja story as she talked to Flores,
- conducting media interviews where she reaffirms the ninja story,
- states that "no jury will ever convict me" because I am "innocent"
- smiles in her mug shot because that is what Travis would have done,
- tries to blackmail the Alexander family by saying give me a pleas deal or I will accuse Travis of being an abuser, porn lover and a pedophile,
- uses DV and self defense for the reasons she DID murder Travis,
- manipulates her experts to give her written material to help her with her DV defense,
- lies on tests given to her to substantiate their opinions of DV and PTSD,
- tries to smuggle out a message to a witness from her jail cell,
- accuses Travis of being a monster, and abuser, a porn lover and a pedophile just as she said she would,
- takes the stand for 18 days to manipulate the jury to feeling sympathy for her,
- smuggles out her artwork to raise money,
- sells plastic bracelets,
- sells t-shirts,
- apparently sells her hair,
- has her parents go on the net to ask for money,
- solicits her minions to ask for donations,
- all of these sales were done 1st she says to give to charity and now it is to raise money for what she says is for a good appellate attorney
- circumvents the IRS as no one knows where this money currently is,
- represents herself for a short time for the sole purpose of getting in witnesses
- uses her defense to say throughout this second trial that she was wrongly convicted and presents almost another whole case rather than putting on a mitigation case,
- Ignores that she has been convicted of First Degree Premeditated Felony Murder with Extreme Cruelty[/b]
- once again uses experts in this current trial that were proven to not be credible as they based their opinions solely on her words
- solicits people to lie and swear on affidavits,
- files motion after motion, citing prosecution misconduct et al,
- too bad for her they were all denied!
- testifies long enough to tell lies about childhood abuse at the hands of her parents AND to bring up they were drug users,
- has no supporting evidence of these accusations against her family - in fact, she was the one who had the police called on her for growing pot on the roof of her family home - and called by her parents!
- testifies long enough to tell lies about past relationships (prior to Travis),
- lie after lies after lie
I know I left out a lot but I just wanted to back up the statement made by Crime Time and why I agree.
Martinez has exposed all the lies and he is not done yet.
Yes, he will bring back the details of the slaughter at the hands of Arias and why the jury is there.
He will once again bring Travis back to the forefront in this case and the senseless death of a good man at the hands of Arias.
Arias will speak in much the same way that she did in the first trial but her lies that have been proven and the lies from her "witnesses" that have been proven will prevail.
There is nothing that she can say to refute this.
She cannot use her parents this time as the reason that she wants to live because she trashed them so horribly in her testimony.
The jury will see that no one came forward with credible testimony to say why she should live.
She will say another long speech that shows no remorse on her part but rather that everyone got it all wrong and she should be exonerated.
She will play the victim to try to get sympathy from the jury.
She will NOT say to the jury, "yes, I killed Travis in a horrendous manner and I ask for mercy from you".
She will possibly say once again that this was one day in her life and she should not be defined by this one day.
She will lose!

During DeMarte’s testimony, Martinez will be able to play the video or use a transcript of the testimony of two other ex girlfriends of Travis Alexander who testified in the murder trial that Arias stalked Alexander while they were dating him and that Alexander had never physically, verbally or emotionally abused them.
In the first trial, Mimi Hall testified for the state that Travis Alexander had told her that a former girlfriend had slashed his tires, slashed his girlfriend’s tires, sent threatening emails to his girlfriend, crawled through his doggy door and slept on his couch at night without his knowledge and followed him and Mimi around on dates.
During cross examination, Nurmi marched over to Hall thinking he could prove her a liar by saying Mimi had told him in a deposition that Travis did not name Jodi Arias as his stalker. Mimi stated that was true Travis Alexander had never told her the name of the former girlfriend who stalked him.
The girlfriend Mimi was referring to who got the threatening email and her tires slashed was Lisa Andrews Diadone who was called to testify for the defense concerning an email she sent Alexander. Lisa was not allowed to talk about the stalking or the slashed tires but during juror’s questions, one juror asked Diadone if she believed Jodi Arias was Travis’s stalker and she answered yes.

Well, so many of us may have not liked that hearsay could be brought into this phase, but now, through DeMarte, Martinez will be able to use this hearsay regarding what former girlfriends confided to DeMarte.
I just finished watching (again) the "Jodi Arias Documentary - (In her own words) - 48 Hours Mystery".
It was evident that no tears were shed throughout this interview even though she wiped her dry eyes for effect.

It is so evident how much of a pathological liar she is AND how easily she does it.
She opened the interview by saying she was a photographer and artist. She goes on to say that her camera was always with her AND that she was far more comfortable behind it than in front of it.
Again I find this very interesting as I have yet to see any of her photography work. What I have seen are so many pictures of her, alone and with Travis AND holding her camera.
When asked about her family, she stated that they were almost the ideal family and that all of them were very close.
Her arrogance came through all the way also.
When asked if she felt that Travis was cheating on her, she stated she was suspect he was so she took his phone and began reading his text messages. She stated this so matter of fact as if this was no big deal and almost like she had every right to do it.
When Flores went to Yreka to arrest her, he stated that she did not act at all surprised as to why he was there but instead asked if she could have her purse with her so she could put her make-up on.
She continued to hold press conferences (even in her jailhouse garb) and said that although the evidence against her seemed very compelling, it in no way proved that she had anything to do with the death of Travis.
Interesting that the state asked for a 2 million dollar bond when she was arraigned in court (which of course she could not post). Quite obvious that they had a mound of evidence to support the charge of First Degree Premeditated Murder
I wish that this jury could hear these interviews. Again, it is the ease at which she lies bold-face, to the camera, the interviewer and all those who will watch.

Wow! I've been busy with work and I see I missed a lot here. I love all the information here. Backed up with facts. Not guessing or assuming. Luna, I was not offended at all. If I were I would have to assume that you all here are nasty mean people. I have learned never to assume...I wonder if the jury are thinking. Where are the midigators? The defense rested and NO ONE spoke on her behalf. Right.??? It seemed that all they did was trash travis. I hope they see that. Wow. !! I would never hire either one of the defense team to fight as much as a speeding ticket. ...thanks again for all the great information.!

I am wondering, since so much time has passed since Dr. DeMarte last testified so beautifully, will she now update her diagnosis? It seems to me that as time has gone by, Arias' attempts to trash Travis and her futile attempts to trash others, like her parents, Deanna (only because she hates her so much), the Bishop, Juan Martinez, Detective Flores...anyone who does not buy into her lies, she tried trashing. Maybe Dr. DeMarte can now include her behavior since her original trial and conclude even more in her evaluation of Arias. I can only hope, can't I?
To me, her ongoing behavior only shows more than ever before that she is either (or perhaps both) a Sociopath and/or a Psychopath, on top of her Borderline Personality Disorder. Her ongoing actions, changing her stories, enlarging the list of names of those she 'blames', and lying about them while acting as if she should be 'rewarded' for this brutal murder seems (to me) more evidence than ever that she is a full blown Sociopath and/or a Psychopath. But I admit, I'm not trained in these things, so my opinion does not mean much.
I sincerely hope Dr. Randle can offer some insight on this later, when she evaluates things from this trial. I know that Dr. Stone (wasn't that his name?) gave her a rather low rating on his scale, but now as time has gone by, would he change that and put her higher up in his numbers? I'd really love to hear more as updates from both Dr. Randle and Dr. Stone.

Hi Justjrep - I neglected to add my welcome to this forum.
I believe that the jury has front and centre in their minds the lack of any mitigation witnesses coming forward with the exception of the 2 affidavits.
And, they are fully aware that at least one of the affidavits was filled with lies as proven by the State.
As I suspected, the 14 or so witnesses the defense (Arias) said they had was bogus. They may have had them on the list but had absolutely no intention of ever calling them. They were useful for the motion to testify in secret that they filed and subsequently LOST! That was their sole purpose in this trial.
Nurmi and Willmott were appointed to this case and could not get off of it despite the repeated efforts to do so AND the 12 page letter Arias sent to have Nurmi fired. They knew full well from the very beginning that Arias was guilty of the charges brought against her and by the time this trial began, bought into the defense that Arias wanted presented. They are a disgrace to their profession in the defense that they mounted by when it is coming from a manipulative, lying defendant, what can be expected?

I believe that it was you that commented that money was a factor in Arias slaughtering Travis.
I think this is very valid. Couple it with the abject rejection she got from Travis and it explains her murderous deed.

I found it on my own under the title Jodi Arias Documentary 48 Hours Mystery. The title confused me. Once I started watching it, I recognized seeing it before. It was actually the 48 Hours TV show I watched that peaked my interest to watch the trial. I saw it right as the trial began although it was originally shown probably shortly after she was extradited from Yreka to Phoenix. This was back when Flores was believing that the gunshot came first and he was stabbed later, probably based on what Arias told him after a night in jail when she made up the Ninja story. In this interview she looks Maureen Maurer right in the eye and lies her pants off as she says she had an idyllic childhood, she was a photographer, Travis wanted her to move to Mesa, invited her to Mesa the day she killed him and two masked intruders knocked them both out and murdered Travis and let her go. She smiles sweetly as she cloaks herself in the veil of innocence and claims she will not be the first person to be wrongfully convicted and perhaps sentenced to death or Life without parole.
My favorite quote was when Samantha looked at Maureen Maurer and said "Don't be fooled by Jodi Arias's lies. She was obsessed with my brother. I loved it that Taylor Searle said Travis was happy when he had told her it was over and was going on with his life with a new girl he had just met. Searle also said as soon as Travis Alexander's body was found, he took out his laptop and went to Arias' Facebook page and showed the cops Arias' picture and said, "Look at this girl." Flores also said Jodi Arias' name came up over and over when he interviewed Alexander's friends. Sky and Chris told the story about Arias hearing the private conversation that had with Travis outside the door and having a scary evil look in her eyes and they telling Travis he couldn't bring her to their house anymore.
The show would have been better if they had not interviewed the pathological lying sociopath. I enjoyed listening to the comments made by Detective Flores, Taylor Searle, Samantha, Stephen, Skye and Chris and Alexander's other two friends but I could hardly stomach watching and listening to Jodi Arias because her smirk, claims of innocence and manipulation as she weaved her web of lies make me sick to my stomach. I don't believe a word out of her mouth. She was never a photographer. She didn't have an idyllic childhood. She and Travis never traveled after they broke up and she moved to Mesa. Travis did not invite her to Mesa and two intruders dressed in black did not massacre them. All this crap about being confident that God would not punish her for this crime because he knows she would never hurt Travis and she would prefer the death penalty made me want to throw up.
Arias described Travis as wonderful, handsome, likeable and a good guy and talked about their relationship as being great. This was before she made up the crap about him being a pedophile and a vicious evil abuser with a Jekyll and Hyde personality that she is spewing now to get out of the death penalty. Every time she opens her mouth she lies. One lie replaces another.

The day she left to go and kill him, Juan showed texts and calls that she made to Travis. He finally replied twice. I think she tried reaching him 11 times that day, but that's from memory. I do know she called him A LOT and he finally replied a couple of times.
But, she had notified Darryl Brewer to borrow gas cans first in May, then when she was headed his way to get them, in June. My point is...Travis was NOT begging her to come and see him that day, as she said.
