The Jodi Arias mitigation retrial is different than most mitigation trials because the defense is putting the victim on trial rather than begging for Arias life.
In most mitigation trials, the defense calls relatives, friends and teachers of the convicted murderer to show he or she was a good daughter, friend and student.
Arias and her family won’t do this because they believe Arias was wrongfully convicted and what the state is doing is trying to kill an innocent person.
On Jan. 25, Sandra Arias signed a petition: Government of Arizona. Don’t kill a battered woman for defending herself. Save Jodi.
Arias and her family think signing petitions, selling propaganda and drawings and soliciting donations to pay a high powered appellate attorney on Internet sites Jodi Arias is Innocent and Justice4Jodi is going to win Arias her freedom.
They are as misguided as these murderers who don’t defend themselves because they don’t recognize the government so believe the government has NO right to try them or kill them. They end up being executed because the government does have that right.
Jodi’s mother could take the stand and say what she said to Detective Flores: “Jodi has mental problems. Her friends say she is Bi Polar. She needs help. She didn’t have a bad childhood. She is making this all up. Please don’t kill my daughter.”
But she won’t because that would make Arias furious. She would be happy if her mother stood up and said: “I was a bad mother. I smoked pot the day I delivered Jodi. I beat Jodi with a wooden spoon and I didn’t protect her from her abusive father. Jodi was the perfect child. She didn’t do anything wrong. She is a battered woman defending herself from a monster just like her father.”
But she won’t say that because it is not true and because Martinez would show the interrogation tape where Sandra Arias tells Flores that Arias didn’t have a bad childhood and just made that up and that Arias would call her one minute happy and the next angry or sad, that she grew pot on the roof and she and Jodi’s father called the sheriff. That shows Bill and Sandra Arias were NOT drug users as Arias made them out to be.
Because this is a new jury and essentially a retrial, the defense has left out any mention of self defense, the lurid details of Arias’ sex life from the time she was a teenager and that she was Alexander’s dirty little secret.
Instead, the defense is painting the picture that Arias killed Travis Alexander because he was a sex maniac who lured her to Mesa to use her for sex and Arias thought he was going to propose to her and when he didn’t she just lost it and stabbed him 29 times and slit his throat and shot him in the head.
Arias thinks she manipulated the jury in her “secret” testimony into believing she was remorseful and a victim of child abuse and domestic violence and that when she tells them she has been donating her hair and proceeds from her drawings and personal belongings to food banks, children and women dying of cancer and survivors of domestic violence, none of those gullible saps on the jury will want to put a victim and philanthropist to death.
It’s not going to fly because from the jury questions this jury doesn’t believe her lies anymore than the jury that convicted her of first degree murder and eight jurors voted for death.
This time I think Martinez has a better chance at the death penalty because I think Arias’ 18 days on the stand made four of the jurors in the last trial form a sympathy bond with her and the more they saw her the more they thought maybe she was abused and it was only one murder and what if that was heir daughter or granddaughter on the stand could they vote to kill her.
Plus Martinez will drive home the cruelty of the crime with the autopsy pictures and the evidence that Arias is making up the pedophile and abuse claims to smear the victim and she continues to lie to this jury and point out the inconsistencies in her testimony at the retrial versus the murder trial.
